News Alert: ABLE Act Becomes Law in North Carolina

A special ALERT from North Carolina Council on Developmental Disabilities

ABLE Act Becomes Law in North Carolina

Governor Signs Bill Allowing People with Disabilities to Setup Savings Accounts

RALEIGH, NC (August 11, 2015) - Governor Pat McCrory today signed into law the ABLE Act, or Achieving a Better Life Experience Act, allowing North Carolina to create tax-deferred savings accounts for people with disabilities and their families.

Photo courtesy of The Arc of North Carolina

"With the signing of the ABLE Act, individuals with disabilities, their families and guardians can save towards their future care and needs without risking their current benefits," said Chris Egan, executive director of the North Carolina Council on Developmental Disabilities (NCCDD).

The ABLE Act allows for families of people with disabilities to save up to $100,000 in a 529 account for disability-related expenses, similar to the tax-deferred accounts used by families for college education.

Under current law, people with disabilities and their families cannot save more than $2,000 without losing supplemental income from the government.

The tax-deferred savings would be used extra expenses not covered by Medicaid like transportation, housing, educational or technological necessities that assist people with disabilities.

The North Carolina legislation is based on the federal law that passed last year after an eight-year effort by national advocates. Over 50 percent of the states have passed their own version(s) of the bill and are now beginning to implement the program.

"We greatly appreciate Governor Pat McCrory signing the bill into law giving approximately 180,000 people living with intellectual and other developmental disabilities in North Carolina the opportunity to build a more secure future without losing other benefits," said Ron Reeve, chair of NCCDD.

In North Carolina, the ABLE Act was sponsored by:

  • Rep. Marilyn Avila (R - District 40)
  • Rep. Donny Lambeth (R - District 75)
  • Rep. Edward Hanes Jr. (D - District 72)
  • Rep. Graig Meyer (D - District 50)
  • Senator Tamara Barringer (R - District 17)
  • Senator Ralph Hise (R - District 47)
  • Senator Tom Apodaca (R - District 48)

The North Carolina Council on Developmental Disabilities (NCCDD) works to assure that people with intellectual and developmental disabilities (I/DD) and their families participate in the design of and have access to needed community services, individualized supports and other forms of assistance that promote self-determination, independence, productivity and inclusion in all areas of community life. The Council identifies problems facing its community through its five-year planning process and funds innovative projects and initiatives that promote the goals of the Developmental Disabilities Assistance and Bill of Rights Act (DD Act) for all North Carolinians.

The Dementia Action Alliance is committed to helping people live fully with dementia and supporting those who care about them.

Help Us Change Attitudes about Dementia!

There are currently 5.2 million Americans living with dementia, including Alzheimer’s in the United States; an amount equal to all the people combined who live in Oregon and Hawaii. Dementia impacts not only the person affected but also his/her family and friends adding another 15 million people impacted - an amount equal to all the people combined who live in Washington, Colorado, and Utah.

People living with dementia and those who support them face many challenges. Besides managing cognitive and physical changes to their health, they deal with isolation and stigmatization because negative information about dementia is the norm for public information. Society’s widespread negative perceptions fuel fear, misunderstanding, and add to the burden of living with the condition. It does not have to be this way.

Learning that people can live fully with dementia is an antidote to misperceptions of dementia. Take a moment (actually 7 minutes) to view “Person-Centered Matters,” an extraordinary video based in hope and possibility about living fully with dementia.

The Dementia Action Alliance is committed to helping people live fully with dementia and supporting those who care about them. We are a volunteer coalition engaged in changing our nation’s understanding of and attitudes about dementia through serving as a trusted source for education, conversations, and advocacy.

GEM LUNCH & LEARN -Please join us as we explore the world of advance care planning

This Tuesday 8/4 at the Baum Center @ 11:30

We welcome Ellie Ward, BSN, RN

Program Coordinator, Education-Community Outreach

Vidant Community Health Outreach

Please join us as we explore the world of advance care planning- that is, going through the steps necessary to create legal documents (advance directives) specifying what care you want (and don't want) that are reflective of your values and what matter most to you, so that the care you receive at the end-of-life matches your preferences.  Advance directive documents will be made available at this session, and for anyone that wishes, can be finalized on site, complete with notary seal (you must have a valid driver's license for this step).  If you have internet access, please visit http://www.vidanthealth.com/advancecare and download an advance care planning toolkit and answer the reflective questions at the front, in preparation for Tuesday's presentation and discussion.  If you do not have internet access, no worries, you will be provided the toolkit and we will go through it step-by-step as a group.

This program is ideally a dialogue, so jot down your questions and any concerns you have about advance care planning, so we can collectively learn from each other.
